My Contribution terms and conditions

Access to and use of the Balfour Beatty My Contribution Online Form (”the Form”) is provided by Balfour Beatty plc of 5 Churchill Place, Canary Wharf, London E14 5HU company number 395826 (“Balfour Beatty”), (“We”) or (“Our”) on the terms below.

By using the Form, you agree to be bound by these terms, effective on first use. If you disagree, please do not access or use the Form.

Acceptable Use

You must comply with our acceptable use standards for My Contribution as notified from time to time. The Form should not to be used to cause distress or inconvenience to any person, obscenity or offense or disruption to Balfour Beatty. We have the right to suspend access to the Form or user identification code or passwords, at any time, if you fail to comply with these terms.

Confidentiality

You agree to keep any user identification code or password issued to you and/or any information relating to ideas or submissions made on the Form confidential and not to disclose such information to third parties without Balfour Beatty’s prior written consent.

Intellectual property

You warrant that any copyright, trademarks, design rights, patents, database rights, know-how or trade secrets (“Intellectual Property”) in any ideas or suggestions you submit when completing the Form have been lawfully obtained, can be used by Balfour Beatty and do not infringe third party Intellectual Property.

You acknowledge that, to the extent permitted by law, any Intellectual Property in any ideas/ suggestions or generated from such ideas/ suggestions you submit when completing the Form, shall be assigned to and vest in Balfour Beatty unless otherwise agreed in writing, and shall be free for Balfour Beatty to use and commercially exploit as necessary for its business purposes.

Copyright in the Form and My Contribution format is owned by Balfour Beatty.

Limitation of liability

Balfour Beatty shall not be liable for any use of or failure to use any ideas or submissions provided by you when using the Form. The use of any ideas or submissions is subject to Balfour Beatty case by case assessment and at Balfour Beatty’s sole discretion. Access to and/or use of the Form is provided on a strictly ‘as is’ basis, Balfour Beatty does not warrant that the Form will be uninterrupted or error free and expressly exclude liability in relation to the availability of the Form to the fullest extent permitted by law.

General

These terms of use are governed by the laws of England and Wales and the English courts shall have exclusive jurisdiction in relation to any dispute arising out of or in connection with these terms.

Changes to these terms

These terms replace all previous versions and we reserve the right to change the terms at any time. Any changes to these terms will be posted here.

PRIVACY NOTICE FOR BALFOUR BEATTY PLC    

My Contribution Online Form

Balfour Beatty plc of 5 Churchill Place, Canary Wharf, London E14 5HU company number 395826 Privacy Notice for your use of Balfour Beatty’s My Contribution form whether as an online form, application or manually issued form used by Balfour Beatty to collect ideas for innovation or business improvement for its My Contribution initiative (“the Form”).

  1. Introduction

This notice sets out the privacy notice of Balfour Beatty plc (“Balfour Beatty or “We”) and/or its Affiliates in connection with the use by Balfour Beatty of any Personal Data you may provide when using the Form (“Privacy Notice”).

“Affiliates” means Balfour Beatty plc or any person which is from time to time controlled by Balfour Beatty plc and for this purpose a person is controlled or operated by Balfour Beatty plc if Balfour Beatty plc, either directly or through one or more intermediaries, beneficially owns shares (or their equivalent) carrying the majority of votes at a general meeting of shareholders (or its equivalent) of the person.

“My Contribution” means Balfour Beatty’s business improvement and innovation ideas and stakeholder engagement programme initiative whereby employees, contractors, suppliers and subcontractors can submit ideas or suggestions in order for Balfour Beatty to innovate or improve it business services or operational business processes or procedures;

“My Contribution Form Site” means the Balfour Beatty site enabled for use with the online version of the Form.

“Data Protection Laws" means any applicable law, statute, directive, legislation, order, regulation or other binding law (as amended or revised from time to time) relating to data protection and/or privacy to which a Party is subject, including the Data Protection Act 2018 ("DPA") and if applicable the GDPR.

“Device” means a mobile, tablet device or computer.

“My Contribution” means an idea or innovation you would like to suggest Balfour Beatty take forwards.

“Personal Data” is information which identifies (or which could, with other information that we hold or are likely to hold, identify) a living individual.

Balfour Beatty plc is a “controller” under the Data Protection Act 2018 and, where applicable, the General Data Protection Regulation (“GDPR”) (“Data Protection Laws”).

  1. Scope of the Privacy Notice

2.1  This Privacy Notice applies to your use of the Form.   

2.2  The Form is to enable Balfour Beatty employees, contractors, suppliers and/or sub-contractors to record information concerning My Contribution. The information will contain Personal Data as set out below.

2.3  This Privacy Notice shall apply when you use the Form either on your Device and/or as otherwise made available to you by Balfour Beatty.

2.4  This Privacy Notice regulates how we collect Personal Data from you, or that you provide to us, and how your Personal Data will be processed by us. For the purpose of the Data Protection Act 2018, the controller is either Balfour Beatty or where the Form is submitted to a Balfour Beatty Affiliate the named Balfour Beatty Affiliate.

  1. Information we and the relevant Balfour Beatty Affiliates will collect from you may be collected and processed as follows:

Information you give us (Submitted information)

  • You may give us information about you by registering your details on the My Contribution Form Site or by corresponding with us by e-mail. This includes information you provide when you, use the Form to submit a My Contribution including any idea or improvement suggestion you put forward when submitting the Form or when you report a problem with the Form
  • The information you give us may include: your name, telephone number, email address, information regarding the details of the business you work for and/or area of such business you work in, your manager’s name, the name of any Balfour Beatty contact you have worked with, if relevant

Information we collect about you and your Device.

Each time you use the Form we shall automatically collect the following information:

  • The information you provide when you populate the Form such as: your name, telephone number, email address, information regarding the details of the business you work for and/or area of such business you work in, your manager’s name and the name of any Balfour Beatty contact you have worked with, if relevant
  • If you contact us, we may keep a record of that correspondence

Legal Basis for Processing: Data Protection Laws require that we meet certain conditions before using your Personal Data as described in this Privacy Notice. For Personal Data which is not classed as ‘special category data’ under Data Protection Laws, unless otherwise notified, we rely on a condition known as "legitimate interests" in order to process your Personal Data for the above specified purposes. You acknowledge and agree that in using the Form, it is in our legitimate interests to process the above Personal Data provided by you in order for us to:

  1. Ensure that appropriate records of suggested ideas are taken into consideration by Balfour Beatty to innovate and continuously improve our business services and business operations and processes and to help evidence that suggestions have been made to Balfour Beatty to take ideas forward
  2. Ensure effective and appropriate administration of the Form and/or the Balfour Beatty My Contribution programme
  3. Management and facilitation of requests from users of the Form

We will ensure that the collection and processing of your Personal Data:

  • Is kept to a minimum with regards to the amount of data collected and the extent of any processing;
  • Will not be overly intrusive to you;
  • Will be proportionate in order to meet our legitimate interests, as above

The Form is not intended to be used for the uploading and/or processing of ‘special category data’ (e.g. race, ethnicity, medical or health data, data relating to trade union membership or political views or religious beliefs, data relating to sexuality or sexual health or genetic or biometric data) and/or criminal record data and you should not upload such data to the My Contribution Form Site when using the Form.

  1. Disclosure of your information

We are part of the Balfour Beatty Group and any Affiliate or member of the Group may disclose your Personal Data to another Balfour Beatty Affiliate or member of Balfour Beatty plc or the Balfour Beatty Group. Group means any Balfour Beatty ‘holding company’ or ‘subsidiary’, as defined in section 1159 of the Companies Act 2006 (as amended from time to time).

We will share your Personal Data or information with the Balfour Beatty Group of companies and, where relevant, their professional advisers. Where required by law or regulatory requirement, or where necessary to fulfil our contract with you, we may also share your information with:

  • Other companies who provide goods/services to us
  • Our professional advisers and auditors
  • Regulators, government departments, law enforcement authorities, and insurance companies
  • Any relevant ombudsman, dispute resolution body or the courts
  • Persons in connection with any sale, merger, acquisition, disposal, reorganisation or similar change in the Balfour Beatty or its relevant Affiliates
  • Third party providers of data centre and cloud server services, such as IT service providers who support the running of the Form and/or the Balfour Beatty My Contribution Form Site and Google Cloud Platform where required for the purposes of allowing such third parties to perform functions on our behalf, where required, for the purposes of IT administration, and administering the My Contribution Form Site
  • Where we are required or permitted to do so by law

We may also disclose your Personal Data to third parties in the following instances:

  • If We sell or buy any business or assets and need to disclose your Personal Data to the prospective seller or buyer of such business or assets
  • If Balfour Beatty or one of its’s Affiliates has substantially all of its assets acquired by a third party the Personal Data held by the entity being acquired is transferred to the purchaser of such assets
  • If required under any legal or regulatory obligations or requests or in order to investigate potential regulatory breaches

Personal Data shall not be transferred to or stored at a destination outside of either the United Kingdom or the European Economic Area (“EEA”).

  1. Where we store your Personal Data

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your data; any data transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

We will not collect and store Personal Data of your Device.

All Personal Data you provide to us via the Form is stored on systems with appropriate technical and organisational security measures and controls located within either the United Kingdom or the European Economic Area, which are sufficient to comply with the requirements under the Data Protection Laws. We will only store your Personal Data for as long as necessary for Balfour Beatty to process such Personal Data for the purposes set out in this Privacy Notice and in accordance with Balfour Beatty’s internal retention policies and procedures as updated and available here.

The accuracy of the information that we hold about you is important to us. If any of the Personal Data we hold about you becomes inaccurate or out of date (e.g. a contact/contact information changes), or you object to or wish to restrict us processing it, please inform us as soon as possible using the contact details below, so we can update our records.

If any of the Personal Data that we hold is inaccurate or out of date, please let us know by contacting either of the email addresses in the Contact Us section below.

Under Data Protection Laws you have the following rights in relation to your Personal Data:

  • Right to access your Personal Data by subject access request
  • Right to have your Personal Data rectified if inaccurate/incomplete
  • Right to object to direct marketing
  • In certain circumstances, the right
    • To have your data erased or removed, and where the Personal Data has been made public, that other controllers processing the Personal Data also erase links to, or copy or replication of, such Personal Data
    • To restrict the processing of your data
    • Of data portability, namely to obtain and reuse your data for your own purposes across different services
    • To not be subjected to automated decision making (including profiling) where it produces a legal effect or a similarly significant effect on you
    • To bring a civil action if there is a breach of the Data Protection Laws
  1. Changes to Privacy Notice

This Privacy Notice is correct as 9 July 2021, however, we keep this notice under regular review. Any changes we may make to this Privacy Notice in the future will be posted on this page and, where appropriate, notified to you when you next start the Form. The updated terms may be displayed on-screen and you may be required to read and accept them to continue your use of the Form or associated services.
