Terms and conditions

Balfour Beatty Group Limited, 5 Churchill Place, Canary Wharf, London E14 5HU company number 00101073 (“Balfour Beatty”) is receiving and reviewing ideas for its innovation fund scheme. The scheme allows supply chain and innovation partners to submit ideas on innovative solutions which deliver value to Balfour Beatty and/or its clients or partners for Balfour Beatty to assess whether to invest in based on selection criteria.

Any award of innovation funding or support (including but not limited to access to Balfour Beatty personnel or sites as applicable) is subject to further investment terms to be agreed with Balfour Beatty.  Any future supply of goods or services between Balfour Beatty and your organisation shall be subject to separate supplier agreement terms to be agreed with Balfour Beatty.

Access to and use of the Balfour Beatty Innovation Fund Submission Form (“the Form”) is provided on the terms below to allow supply chain or innovation partners to submit their ideas to this scheme with Balfour Beatty.

You agree to keep any Balfour Beatty confidential information you receive following submission of the Form confidential and not to disclose such information to third parties without Balfour Beatty’s prior written consent.

You warrant that any copyright, trademarks, design rights, patents, database rights, know-how or trade secrets (“Intellectual Property”) in any ideas you submit when completing the Form have been lawfully obtained, can be assessed by Balfour Beatty and do not infringe third party Intellectual Property.

Balfour Beatty is not under any duty or obligation to use or implement any ideas submitted via the Form and shall not be liable for use of or failure to use any ideas provided by you via the Form.

The use of any ideas and/or any award of funding or support is subject to Balfour Beatty case by case assessment and agreement of further investment terms as required by Balfour Beatty.

Access to and/or use of the Form is on a strictly ‘as is’ basis, Balfour Beatty does not warrant that the Form will be uninterrupted or error free and excludes liability for availability of the Form to the fullest extent permitted by law.

These terms are governed by the laws of England and Wales and the English courts shall have exclusive jurisdiction in relation to any dispute arising out of or in connection with these terms.

We reserve the right to change the terms at any time. Any changes to these terms will be posted here.

 

PRIVACY NOTICE FOR BALFOUR BEATTY INNOVATION FUND IDEA SUBMISSION FORM

This sets out the privacy notice of Balfour Beatty (“Our”, “Us” or “We”) and/or its Affiliates in relation to use by Balfour Beatty of Personal Data you may provide when using the Balfour Beatty Innovation Fund Idea Submission Form (“the Form”) (“Privacy Notice”).

“Affiliates” means Balfour Beatty plc or any legal entity from time to time controlled by or under common control with Balfour Beatty plc or Balfour Beatty Group Limited either by majority shareholding ownership or voting rights;

“Data Protection Laws" means any applicable law, statute, directive, legislation, order or regulation (as amended from time to time) relating to data protection and/or privacy to which a Party is subject, including the Data Protection Act 2018 ("DPA") and, if applicable, the General Data Protection Regulation (“GDPR”);

“Personal Data” is information which identifies (or which could, with other information that we hold or are likely to hold, identify) a living individual.

Balfour Beatty and/or the relevant Balfour Beatty Affiliate processing the Personal Data is a “controller” under the Data Protection Act 2018.

This Privacy Notice and our Corporate Privacy Notice regulate how we process Personal Data provided by you.

Information you give us

The information you give us on the Form may include: your name, telephone number, email address, information regarding the description of your innovation idea or solution, the name of any Balfour Beatty contact you have worked with, if relevant.

Legal Basis: Balfour Beatty shall process Personal Data submitted via the Form under Data Protection Laws, unless otherwise notified, based on a condition known as "legitimate interests" for the below purposes.

N.B. where ideas submitted are taken forward by Balfour Beatty, processing of personal data by Balfour Beatty following idea implementation will be processed as necessary for performance of the contract following agreement of investment terms.

We will also process your personal data to contact you to inform you of information regarding Balfour Beatty challenges for which we require innovation ideas, where necessary for the scheme.  

The Form is not to be used for ‘special category data’ (e.g. race, ethnicity, medical/health data, trade union, political view or religious belief data, sexuality, sexual health, genetic/ biometric data) and/or criminal record data.

You acknowledge it is in our legitimate interests to process your Personal Data to evaluate and assess your innovation idea or solution, ensure effective and appropriate administration of the Form and facilitate the Balfour Beatty Innovation Fund scheme.

We only store your Personal Data for as long as necessary for Balfour Beatty to process such Personal Data for the purposes in this Privacy Notice or where required for legal or regulatory purposes.
